Flow State Swim Co. — Booking Terms & Conditions

Please read carefully before confirming your booking — Suffolk Park, Byron Bay NSW

1. Agreement to Terms

By booking a swim lesson with Flow State Swim Co. (a trading name of Flow State Community Aquatics Pty Ltd, ABN 55 694 937 132), you confirm that you have read, understood, and agree to these Terms and Conditions on behalf of yourself and the child or children participating in the program.

2. Our Program Philosophy

Flow State Swim Co. delivers the Flow State Aquatic Method™ — an anxiety-informed, play-based approach to aquatic education. Our sessions are designed to build emotional confidence alongside physical water skills.

🌧️ We intentionally deliver sessions in natural weather conditions, including light rain. Exposure to the elements is part of our methodology and supports environmental conditioning. Sessions will only be cancelled in the event of unsafe conditions, such as severe weather or electrical storms.

3. Session Locations

Sessions are delivered at the following locations, depending on the program booked:

• Ocean and beach environments, Suffolk Park, Byron Bay, NSW 2481

• Mullumbimby Pool, Mullumbimby NSW

• Client’s private pool (where applicable and agreed in advance)

You will be notified of the specific location at the time of booking confirmation.

4. Age Requirements & Supervision

We welcome children from 2 years of age. Children aged 2–3 years must be accompanied in the water by a parent or guardian at all times unless otherwise agreed with the instructor prior to the session.

A responsible adult must remain at the location throughout all sessions for children under 8 years of age.

5. Medical & Health Disclosure

You are required to disclose any relevant medical conditions, physical limitations, disabilities, allergies, or anxiety-related needs for your child prior to their first session. This information helps our instructors deliver the safest and most appropriate experience.

Failure to disclose relevant medical information may affect your child’s ability to participate safely. Flow State Swim Co. accepts no liability for incidents arising from undisclosed medical conditions.

6. Bookings & Payment

All bookings must be made and paid in full through our website. A booking is confirmed only upon receipt of full payment.

⚠️ All confirmed bookings are non-refundable. By completing your booking, you acknowledge and accept this policy.

7. Cancellations, Credits & Rescheduling

Cancellations by the participant:

• No refunds are available for cancellations made by the participant.

• A credit note valid for 3 months will be issued for cancellations made with a minimum of 24 hours’ notice prior to the scheduled session.

• Cancellations made with less than 24 hours’ notice will forfeit the session fee entirely.

Cancellations by Flow State Swim Co.:

☀️ We run sessions in rain and overcast conditions — this is intentional and part of our program. Sessions will be cancelled and a full refund issued only in the event of electrical storms, extreme weather, or conditions deemed unsafe by the instructor. You will be notified as early as possible in the event of a cancellation.

• If a session is cancelled by us due to instructor illness or unforeseen circumstances, a rescheduled session will be offered.

• Refunds will only be issued in the event of extreme weather cancellation as described above.

8. Photography & Filming

Parents and guardians are welcome to photograph or film their own child during sessions.

• Photography or filming of other children participating in the same session is not permitted without the express consent of that child’s parent or guardian.

• If another child is present, please ask their parent or guardian before capturing any images in which they appear.

Flow State Swim Co. may photograph or film sessions for educational, marketing, and social media purposes. If you do not wish your child to be featured in any content, please notify us in writing prior to your first session.

9. Liability & Risk Acknowledgement

Aquatic activities involve inherent risks, including but not limited to slipping, falling, and immersion in water. By booking, you acknowledge these risks and confirm that your child is in suitable health to participate.

Flow State Swim Co. holds current Public Liability Insurance. Our instructors hold relevant first aid qualifications, including Senior First Aid and Advanced Resuscitation.

To the maximum extent permitted by law, Flow State Swim Co. accepts no liability for injury, loss, or damage arising from participation in our programs, except where caused by our negligence.

10. Privacy

Personal information collected at the time of booking is used solely to deliver our programs, communicate with you about your booking, and meet our legal obligations. We do not share your information with third parties except where required by law.
